Insolvency proceedings have a public nature and require disclosure of massive amounts of personal information. At the same time, each individual has a right to the protection of personal information. Publicly available information about insolvency proceedings may bar the ‘fresh start’ that an insolvent person reasonably expects. This article analyses the protection of personal data in insolvency proceedings of individuals. It is construed of three parts, where the first part analyses the protection of personal data as a fundamental human right; the second part deals with possibilities to find a balance between publicity of insolvency proceedings and protection of the right to personal information; and the third part compares Ukraine’s and European Union’s legal regimes on treatment of personal data in course of debt discharge proceeding. The problem was analysed using analytical, structural-functional, synthesis and comparison methods.
