<abstract xmlns="http://www.w3.org/1999/xhtml"><p>The article examines the current regulations of the transfer of criminal proceeding in the European legislation, indicating the differences from other forms of International legal cooperation in criminal matters, such as: transfer of sentenced persons and mutual recognition of judgments.</p><p>The study highlights the importance of the transfer of criminal proceeding for the International legal cooperation in criminal matters between the European countries. Its main objective is by preventing the conflicts of jurisdiction between the States concerned to ensure a more efficient, procedural economical and lawful prosecution of crimes.</p></abstract>
