Control of Remote Workers by Means of Artificial Intelligence

Remote work, by its very nature, is characterised by the performance of the duties of the employment relationship, in whole or in part, at a place chosen by the employee, at a time agreed upon with the employer. Despite the fact that the employee performs his/her work outside the employer’s place of business, he/she remains under the employer’s control. The issues under consideration here are the scope of this control and the manner in which it is carried out. In my deliberations, I focus on control performed with the use of algorithmic technologies, in particular artificial intelligence, for which a Regulation of the European Parliament and of the Council Laying Down Harmonised Provisions on Artificial Intelligence (Artificial Intelligence Act) was adopted on 23 June 2023.
