Procedural Aspects Regarding International Arbitration

Abstract

Socio-economic changes have led to significant changes with regard to the institutions regulated by the 1865 Code of Civil Procedure and other laws, such as Law no. 105/1992 on the regulation of private international law. Among the institutions that have undergone these reconfigurations in the regulation of the Code of Civil Procedure, which entered into force in 2013, one that stands out is arbitration. Our study will analyze the main aspects of private international law arbitration: arbitration agreement, the arbitral tribunal, the proceedings in the matter, as well as the recognition and enforcement of foreign arbitral awards

The Forced Sale of Real - Estate Property Aspects Regarding Procedure and Private International Law

Abstrakt

Abstract

Indirectly enforcement is regulated by the Code of Procedure, as a form of enforcement, seeks the recovery of the creditor’s claim through valorization of the debtor’s property or the seizure of income that it has to receive from a third party. Collection action on real estate as a form of indirect civil enforcement is made by the forced sale of immovable property belonging to the pursued debtor, so that the pursuing creditor would cover the claim. In this scientific approach we will examine the issues of pre-sale formalities, the sale and auctioning of real estate property and adjudicating the real-estate property in the regulation of the Code of Civil Procedure, which came into force in February 2013, as well as in the provisions of private international law incidental in the matter.

Abstrakt

Abstract

This article opens a suite dedicated to State Treasury financial structure optimization. It further develops our previous excursus on State Treasury mechanism, operation policies and practice, alignment to EU regulations, and the influence of fiscal pressure on the EU states economies.

This article concentrates on risk prevention and containment of the possible impact. It further describes the financing policy that has been adopted. The following section describes the effects of the applied policies and practice, as well as the accessed financial package.

We have included a lessons learned section, to outline what we strongly believe should achieved for enriching the data sets and processing automation - these being instrumental to ensure the accuracy and relevance of the decision process and actions.

We finally project the main theme of the future articles and to outline the need of competitive central administration partner for the national business community - which is tightly and ever tighter connected to its global counterparties.

Individual Consequences of Internal Marketing

Abstract

Since the emergence of the concept of internal marketing in the literature there have been almost 40 years. This period was marked by a constant increase of the concerns in the internal marketing area, these efforts being evidenced by the publication of a consistent number of articles (conceptual and empirical) which analyze this subject. Considering the previous empirical studies, most of them have focused on studying the relationship between internal marketing and employee satisfaction and / or organizational commitment. However, the relationship between internal marketing and its consequences has been less analyzed in the context of emergent economies. In this paper we aimed to analyze the individual consequences of the internal marketing in the Romanian economy context, focusing our attention on three constructs: employee satisfaction, organizational commitment and organizational citizenship behavior. The research was conducted on a sample of 83 medium and large companies in various sectors of the Romanian economy. In order to proceed with the statistical data analyses we followed these steps: verifying the scales reliability, determining factor loadings and research hypotheses testing. Our research results are consistent with results of previous studies showing that the adoption of internal marketing practice has a positive effect on employee satisfaction, organizational commitment and organizational citizenship behavior

Organizational networking refers to firms‘ behaviours as activities, routines, practices which enable an organization to make sense of and capitalize on their networks of direct and indirect business relationships. The relationships are more important today when the business environment is more competitive. The firms can develop their organizational networking strategies by developing their network capability which refers to its ability to build, handle and exploit relationships. These capabilities are included in a complex configuration with other capabilities and competencies. The aim of this paper is to explore how network capabilities are structured and we tried to understand how they could be improved in order to obtain higher performance. Achieving a good network position that allows firms to make use of business opportunities is a main strategic aim of firms

Profit-maximizing behavior or moral integrity? Can companies have both? Our study takes a look at 300 U.S. based companies listed on the New York Stock Exchange and NASDAQ, and their way of dealing with business ethics. The research undertaken focuses on the content analysis method, using the corporate Codes of conduct and Corporate Social Responsibility (CSR) reports. The study reveals the evolution of the corporate ethics policies and programs throughout the years 2010- 2014. We also take a look at the most frequent controversies concerning business integrity, by sectors of activity

Standard-Setters Versus Big4 Opinion, Concerning Iasb Revision Project of the Conceptual Framework for Financial Reporting. the Case of Presentation and Disclosures Chapter

Abstrakt

Abstract

On the last decades the accounting system haven‘t been able to follow the dynamics of the economic systems generated by the globalization process. In order to reduce the lag between the demand of financial information and the offer of financial information, IASB has started numerous initiatives aiming the increase on the quality of the financial information. Among the current list of current IASB major projects there is also the project of revising the actual conceptual framework for financial reporting. This study is designed to give some directions that will be considered on the exposure draft of this project, analyzing the comment letters submitted by the members of ASAF and the Big4 as well. The study reveals the increasing importance the preparers and users give to the disclosures included on the notes to the primary financial statements. Moreover, on this study we emphasize several challenges that IASB has to face on issuing the exposure draft for this important project. Some of the main challenges refer to the narrow scope of the financial statements, the criteria used on classification, aggregation and offsetting, or the use of the materiality concept

Although it is mostly used in Medicine, the placebo effect has been exploited in Marketing as well, in recent years. In Medicine, the placebo effect is defined as the improving state of a patient as a result of administering a simulated treatment, without any therapeutic healing effect. The current paper presents the results obtained in the studies that tested the placebo effect in marketing, and the conclusions of an experiment in which the possibility of producing the placebo effect on the consumer when the country of origin of an identical product differs was tested

The Bioeconomy Model in Future Sustainable Development

Abstrakt

Abstract

The future of sustainable development is the bioeconomy with the ―global‖ solution; both global and local action for developed the renewable energy generation. When local solutions are implemented is being laid for global solutions are positive affect the national economy. The implementation of the bioeconomy strategy used by society to prevent urgent problems, such as increasing competition for natural resources, climate change, rural sustainable development. The bioeconomy is a new economic and social order and promotes systemic change from using non-renewable resources to renewables. Bioeconomy reveals that production, which involves the transformation of a limited stock of matter and energy, but respecting the same laws that govern entropy closed systems, the entropy or unavailable matter and energy in the forms tend to increase continuously. Economic growth not only increases the apparent output per unit of inputs, which is performed using finite stock of matter and energy in the world. The current economy is based on fossil fuels and other material inputs suffering entropic degradation, both in the raw material extraction and pollution. The production, even if technical progress leads to lower overall yields. The idea of a steady state as the final economic growth that perpetuated indefinitely pendulum model is an impossibility
